The U.S. General Services Administration (GSA) Office of Acquisition Policy issued a Final Rule effective May 23, 2019, amending the General Services Administration Acquisition Regulation (GSAR). The Final Rule effects GSAR Part 515, Contracting by Negotiation, GSAR Part 538, Federal Supply Schedule Contracting, and GSAR Part 552, Solicitation Provisions and Contract Clauses.
The Final Rule, published in the April 23, 2019, edition of the Federal Register (84 FR 17030) updates and clarifies existing Federal Supply Schedule (FSS) contract administration policy and procedures.
The Final Rule is extensive, implementing thirty new FSS-specific clauses and provisions, previously implemented through internal GSA policy and currently in FSS solicitations and contracts. Four additional FSS-specific clauses and provisions, previously removed from the GSAR as part of GSA’s rewrite of its General Services Administration Acquisition Manual (GSAM), but retained by internal GSA policy were reinstated and given new clause/provision numbers.
Ten existing FSS-specific clauses and provisions were updated to reflect current references and practices. Additionally, the Final Rule includes technical amendments correcting typographical errors and minor administrative changes.
The new and revised clauses make no changes to the FedBizAssist Flowdown Matrices Subscriptions, although the date of GSAR Clause 552.212-71—Commercial Terms and Conditions Applicable to GSA Acquisition of Commercial Items is updated to read “(MAY 2019)” which contains a previously-prescribed flowdown already contained in the FedBizAssist matrix for GSA.
